Albion, Lannett End Generic Vitamin Spat

Law360, New York (July 14, 2009, 12:00 AM EDT) -- Albion Laboratories Inc. has resolved a bitter dispute that accused Lannett Co. Inc. of infringing two patents by using Albion’s iron supplement Ferrochel in a generic neonatal vitamin.

Judge Dee Benson of the U.S. District Court for the District of Utah on Monday dismissed the pharmaceutical companies’ claims and counterclaims with prejudice after the parties jointly moved to end the case earlier this month.

Under the order, the parties have waived all rights of appeal and agreed to bear their own legal fees.
