11th Circ. Revives Home Depot Retaliation Claim

Law360, New York (July 14, 2009, 12:00 AM EDT) -- A federal appellate court has affirmed the bulk of a lower court's decision to dismiss a sexual harassment lawsuit brought by two former store managers against Home Depot USA Inc., but it revived a retaliation claim in the case.

In a decision Friday by a three-judge panel of the U.S. Court of Appeals for the Eleventh Circuit, the judges said the U.S. District Court for the Southern District of Alabama was right to dismiss the claims of harassment as well as state law claims of assault...
