PTAB Won't Review Design Patent For Levitating Light Bulb

Law360 (January 18, 2019, 5:38 PM EST) -- A company that makes levitation gadgets lost its bid for post-grant review of a design patent that covers a floating light bulb, with the Patent Trial and Appeal Board saying the company hadn’t shown the patent is likely invalid.

The PTAB denied Levitation Arts Inc.’s request for review on Thursday after finding that a picture of the light bulb that was posted on Facebook in 2015 by the owner of the patent, Flyte LLC, couldn’t be used as evidence to argue the patent was obvious.
