NM Wins Bid To Return Seroquel Suit To State Court

Law360, New York (July 20, 2009, 4:58 PM EDT) -- A federal judge has granted New Mexico's request to shoot back to state court its lawsuit against AstraZeneca Pharmaceuticals LP alleging that the drugmaker’s deceptive marketing of its antipsychotic drug Seroquel led to preventable payouts from the state's Medicaid program.

On Thursday, U.S. District Judge Bruce Black agreed to remand the case brought by Attorney General Gary King on behalf of the state, finding that the federal court lacked jurisdiction over the matter.
