Former Tyco Execs Seek Reversal Of Conviction

Law360 (October 4, 2006, 12:00 AM EDT) -- Claiming they were victims of a “post-Enron backlash,” former Tyco International executives Dennis Kozlowski and Mark Swartz have asked a judge to throw out their fraud convictions.

Kozlowski’s attorneys claimed that his lavish spending and high salary were perks of his executive compensation package, and that “if failing to adhere meticulously to all of the niceties of corporate governance were a crime, Dennis Kozlowski might have been guilty, but so, no doubt, would be hundreds of other corporate executives,” according to court documents.
