Pa. Judge Slams Ore. Judge While Tossing Youth Climate Suit

Law360 (February 19, 2019, 10:22 PM EST) -- A Pennsylvania federal judge on Tuesday tossed a suit from the Clean Air Council and two children challenging government rollbacks of environmental regulations, while ripping an Oregon federal judge who let a similar suit move forward.

U.S. District Judge Paul S. Diamond found that the plaintiffs’ alleged right to life-sustaining climate systems is not a fundamental liberty interest, noting that Oregon-based U.S. District Judge Ann Aiken made the only finding that has recognized this interest in Juliana et al. v. USA.
