ADM Soybean Byproduct Import Not Subject To Tariff

Law360, New York (July 27, 2009, 7:44 PM EDT) -- Archer Daniels Midland Co. will not have to pay a duty to import a soybean oil byproduct used to produce Vitamin E, a federal appeals court has ruled, overturning an earlier ruling by the U.S. Court of International Trade.

Responding to a March ruling by the U.S. Court of Appeals for the Federal Circuit, the CIT entered a ruling on Wednesday classifying the byproduct, a foul-smelling, yellowish-brown solid known as deodorizer distillate, under a duty-free subheading of the Harmonized Tariff Schedule of the U.S.
