Insurer Seeks Distance From Birth Defects Suits

Law360, New York (July 28, 2009, 10:22 PM EDT) -- An insurance company has filed a motion for declaratory judgment in Florida federal court, seeking to have the court release it from any liability in connection with two lawsuits brought by tomato field workers over pesticides that allegedly cause birth defects.

On Monday, Steadfast Insurance Co. filed a complaint for declaratory judgment in the U.S. District Court for the Middle District of Florida, hoping to prevent being asked to shell out to defend Pacific Tomato Growers Ltd and ATG Holding Co. in a pair of suits....
