Circuit Ct. Remands Bankruptcy Auction Antitrust Suit

Law360 (October 6, 2006, 12:00 AM EDT) -- A U.S. appeals court panel has sent a case involving the hot rolled coil industry back to district court, where a judge will decide whether Nucor Corp. violated antitrust laws by outbidding Gulf States Reorganization Group Inc. in a bankruptcy auction.

In its opinion, handed down Thursday, the U.S. Court of Appeals for the Eleventh Circuit ruled that GSRG had properly demonstrated both causation and antitrust injury in its suit against Nucor Corp.
