Apple’s PTAB Win Axed As Fed. Circ. Cites Scant Evidence

Law360 (March 8, 2019, 8:04 PM EST) -- The Federal Circuit on Friday reversed Apple Inc.'s successful challenge to a software developer's data processing patent, finding for the second time that the Patent Trial and Appeal Board didn't supply enough evidence to back up its decision invalidating the patent.

In a precedential decision, the panel said the board's reasoning for invalidating PersonalWeb Technologies LLC's data sorting patent "lacks substantial evidence," echoing similar arguments the circuit court made when it sent back Apple's earlier win in the case two years ago for additional briefings.
