US Pushes To Toss Hitachi Suit Over TV Duties

Law360, New York (July 29, 2009, 2:35 PM EDT) -- Citing lack of jurisdiction, the U.S. government has asked the U.S. Court of International Trade to throw out a suit by Hitachi Home Electronics America Inc. alleging that it was improperly charged duties for importing flat-screen televisions from Mexico.

In a motion filed Tuesday, the U.S. government argued that the CIT should dismiss the complaint for lack of jurisdiction, because Hitachi did not exhaust the appropriate administrative remedies before filing suit.
