2nd Circ. Revives $20M Dana Trade Secrets Suit

Law360, New York (August 3, 2009, 4:36 PM EDT) -- A federal appeals court has revived Jasco Tools Inc.’s $20 million lawsuit alleging that Dana Corp. conspired with Jasco’s former employees to misappropriate the precision machining company’s trade secrets.

On Friday, Amayla Kearse, Peter Hall and Debra Ann Livingston of the U.S. Court of Appeals for the Second Circuit held that the bankruptcy court improperly granted summary judgment to Dana, giving new life to Jasco’s claim that Dana participated in a scheme hatched by former Jasco employees to take Dana’s business to rival machinist Nationwide Precision...
