Bird Fires Back In $3.6M Asbestos Claims Billing Spat

Law360, New York (August 3, 2009, 4:14 PM EDT) -- Roofing products maker Bird Inc. has fired back in a suit Nationwide Indemnity Co. launched to recover almost $3.6 million in unpaid invoices for hundreds of asbestos-related claims, alleging the insurer incompetently administered the billing process.

Bird claims that Employers Insurance Co. of Wausau, which contracted Nationwide to manage the claims, has not upheld its end of a settlement agreement that apportioned costs for the asbestos liabilities, in a counterclaim filed Friday in the U.S. District Court for the District of Massachusetts.
