Cert. Bid Fails In State Farm Katrina Payout Suit

Law360, New York (August 4, 2009, 4:10 PM EDT) -- A federal judge has denied a Louisiana couple's bid to certify a class action against State Farm Fire & Casualty Co. over an allegedly flawed method it used to calculate insurance payouts to victims of Hurricane Katrina.

On Monday, Judge Stanwood Duval Jr. of the U.S. District Court for the Eastern District of Louisiana rejected Kathleen and Gordon Schafer's certification motion, ruling that the request did not meet the predominance requirement for the designation.
