Judge Rules Tropicana Did Not Infringe Land O'Lakes Design

Law360, New York (October 21, 2003, 12:00 AM EDT) -- A federal judge in the U.S. District Court in Wilmington, Delaware ruled that a plastic juice bottle produced by PepsiCo's Tropicana unit does not infringe a design patent owned by Land O'Lakes for a bottle shaped "like a buxom woman," Bloomberg News reported.

Judge Joseph J. Farnan noted that Tropicana's bottle "looks like a sphere atop a straight cylinder (or an orange suspended above a juice glass)," and that no "rational" court would find the designs so similar that they "would be induced to mistakenly purchase...
