Pa. Hospital Worker's Age, Disability Suit Comes Up Short

Law360 (April 24, 2019, 6:04 PM EDT) -- A Pennsylvania federal judge has tossed an age and disability bias suit from a hospital worker who didn't get rehired after taking medical leave for cancer treatment, accepting Mercy Catholic Medical Center's argument that it was following internal policy when it hired a less experienced replacement.

U.S. District Judge Mitchell S. Goldberg granted summary judgment to Mercy Catholic Medical Center on Tuesday in Arlene Davis Roberts' suit alleging it violated the Americans with Disabilities Act and the Age Discrimination in Employment Act when it passed her up for a less qualified, younger and non-disabled candidate upon Roberts' return from medical leave....
