Antitrust Law Can't Touch State Hospice Regs: Wash.

Law360, New York (August 6, 2009, 5:03 PM EDT) -- The state of Washington has fired off a motion fighting an antitrust suit filed by Odyssey Healthcare Inc., arguing that the regulations of new health facilities that the hospice provider has challenged are immune to regulation under the Sherman Act.

On Wednesday, the Washington State Department of Health filed a motion for judgment on the pleadings in the antitrust suit filed by Odyssey in the U.S. District Court for the Western District of Washington.
