8th Circ. Hands Contractor Win In Insurance Spat

Law360, New York (August 7, 2009, 7:00 PM EDT) -- The U.S. Court of Appeals for the Eighth Circuit has reversed a lower court's decision in favor of a group of insurers, including Lloyd's of London, in a breach of contract and bad faith denial of an insurance claim suit related to water damage sustained at a Florida retirement community.

On Thursday, the Eighth Circuit overturned the U.S. District Court for the Southern District of Iowa's award of summary judgment to the insurers, handing plaintiff the Weitz Co. LLC a victory.
