Enviros Take Idaho Mine Expansion Suit To 9th Circ.

Law360, New York (August 7, 2009, 3:44 PM EDT) -- The Sierra Club, the Natural Resources Defense Council and other environmental groups have appealed a ruling that their claims lack merit, in a suit seeking to block the U.S. Forest Service and other federal agencies from allowing an Idaho phosphate mine to expand further into a national forest.

The groups, which also include the Greater Yellowstone Coalition and Defenders of Wildlife, filed their appeal in the U.S. Court of Appeals for the Ninth Circuit on Thursday, challenging a district judge in Idaho's award of summary judgment...
