Improving Design Protection In Chinese Patent Law

Law360, New York (September 15, 2009, 3:51 PM EDT) -- Last December, China's top legislature, the National People's Congress Standing Committee, approved amendments to China's patent laws.

The new laws will come into effect Oct. 1, 2009, and include significant changes to the country’s patent system, including an absolute novelty requirement, a possible roadmap for compulsory licensing and increased statutory damages for infringement.

China’s developing design patent system is also affected by the amendments. Inventive designs are now given a specific definition that includes product designs for shapes, patterns and combinations of colors, shapes and patterns....
