High Court Tax Board Case Sparks Fight Over PTAB Immunity

Law360 (May 16, 2019, 7:51 PM EDT) -- The University of Minnesota has told the Federal Circuit that a new U.S. Supreme Court ruling that states can’t be sued in another state’s court bolsters the university’s position that its patents are immune from inter partes review, leading the companies challenging the patents to scoff.

The university, which is appealing a Patent Trial and Appeal Board decision that it waived its state sovereign immunity to inter partes review by filing infringement suits over its patents, said in a letter to the appeals court Tuesday that the high court's Monday ruling in a tax case weighs in its favor.
