High Court Asked To Limit Juries' Role In Patent Suits

Law360, New York (August 17, 2009, 3:30 PM EDT) -- Medela Holding AG, which is locked in a long-running patent spat with Kinetic Concepts Inc. over wound-healing vacuum technology, has asked the U.S. Supreme Court to hear its case challenging the ability of juries to determine important patent validity issues such as obviousness.

In a petition for a writ of certiorari filed Aug. 13, Medela said the unpredictability introduced by jurors attempting to rule on legal issues such as obviousness is not good for the patent system.
