Dow Takes NMFS Pesticide Challenge To 4th Circ.

Law360, New York (August 21, 2009, 6:09 PM EDT) -- Dow AgroSciences LLC and two other chemical manufacturers have announced they will appeal a federal judge's dismissal of their suit challenging findings on pesticides by the National Marine Fisheries Service.

The companies filed a joint notice of appeal Thursday in the U.S. District Court for the District of Maryland, saying they would take their case to the U.S. Court of Appeals for the Fourth Circuit.

Judge Alexander Williams tossed the case on July 29, ruling that the plaintiffs lacked jurisdiction.
