Expert Testimony Tossed In Eaton Antitrust Case

Law360, New York (August 24, 2009, 2:46 PM EDT) -- A federal judge has thrown out testimony from an economist who said Eaton Corp.'s monopolization of the heavy-duty transmission market cost plaintiffs ZF Meritor LLC and Meritor Transmission Corp. as much as $824 million.

U.S. District Judge Sue Robinson of the District of Delaware on Thursday dismissed as “unreliable” the internal financial reports from ZF Meritor on which Dr. David DeRamus based calculation of damages ranging from $606 million to $824 million.
