W.Va. Enviro Agency Found To Have Violated CWA

Law360, New York (August 25, 2009, 5:03 PM EDT) -- A federal judge has ruled that the West Virginia Department of Environmental Protection violated the Clean Water Act by allowing pollutants to be discharged at various bond forfeiture sites without a permit required by federal law.

On Monday, Judge John T. Copenhaver Jr. of the U.S. District Court for the Southern District of West Virginia sided with environmental groups West Virginia Highlands Conservancy Inc. and West Virginia Rivers Coalition Inc. in their battle against WVDEP Secretary Randy Huffman.
