EPA, Vertellus Strike Deal In Clean Air Act Suit

Law360, New York (August 25, 2009, 6:20 PM EDT) -- Vertellus Agriculture and Nutrition Specialties LLC has agreed to pay a $425,000 penalty and upgrade its facilities to settle allegations by the U.S. Environmental Protection Agency and the Department of Justice that the chemical company violated the Clean Air Act at an Indianapolis plant.

In addition to the civil penalty, the chemical company will be required to embark on a $705,000 environmental project to upgrade pumps at the plant with technology that will eliminate fugitive emissions of hazardous air pollutants, according to a consent decree filed...
