USVI Water Pollution Suit Against Dow, Vulcan Nixed

Law360, New York (August 26, 2009, 7:05 PM EDT) -- A federal judge has dismissed a case brought by the Virgin Islands Department of Planning and Natural Resources against The Dow Chemical Co. and Vulcan Materials Co. alleging dry cleaning chemicals made by the two companies contaminated an aquifer in the Virgin Islands.

Judge Curtis V. Gomez of the U.S. District Court for the District of the Virgin Islands agreed with the department that federal courts lacked jurisdiction over the case. The department had filed a suggestion to dismiss the case, saying Virgin Islands superior court...
