Green Group Seeks Cert For Mountaintop Mine Case

Law360, New York (August 27, 2009, 5:40 PM EDT) -- Environmental groups have taken their challenge of a U.S. Army Corps of Engineers permitting process for mountaintop mining to the nation's highest court.

The Ohio Valley Environmental Coalition petitioned the U.S. Supreme Court on Thursday for a writ of certiorari asking the court to review a February decision by the U.S. Court of Appeals for the Fourth Circuit, which tossed a rule requiring the Army Corps to conduct more stringent environmental studies before issuing Clean Water Act permits to mountaintop coal miners.
