DuPont Kevlar Secrets Suit Survives Bid To Toss

Law360, New York (August 31, 2009, 5:30 PM EDT) -- A federal judge has allowed DuPont Co. to pursue its trade secret claims against Kolon Industries relating to the synthetic fiber Kevlar and dismissed Kolon's counterclaim accusing DuPont of violating antitrust laws.

However, Judge Robert Payne of the U.S. District Court for the Eastern District of Virginia encouraged Kolon to file an amended counterclaim regarding DuPont's alleged antitrust violations. He also dismissed a third-party complaint Kolon filed against the former DuPont employee at the heart of the dispute.
