Feds Help Pave Way For E-Health Technology

Law360 (October 17, 2006, 12:00 AM EDT) -- The Centers for Medicare and Medicaid Services (CMS) and the Office of the Inspector General (OIG) recently issued final rules to create two new exceptions to the Stark Law (Stark) and two new safe harbors to the Anti-Kickback Statute (AKS) that will permit, under certain circumstances, the donation of health information technology items and services for the purpose of improving electronic prescribing and electronic health records (EHR) capabilities.
