6th Circ. Upholds Jury Verdict On Steel Contract

Law360, New York (September 2, 2009, 2:00 PM EDT) -- A federal appeals court has upheld a jury verdict in favor of steel supplier Choice Fabricators Inc., saying the company never breached its contract with appliance maker Copeland Corp. because the two parties consensually modified the contract through e-mail.

Requests Copeland employees made via e-mail asking Choice to detail extra charges it had levied as part of a steel supply contract constituted a legal, consensual modification of that contract, the U.S. Court of Appeals for the Sixth Circuit said in a Sept. 1 opinion.
