Miss. Wants Teva Fraud Suit Back In State Court

Law360, New York (September 3, 2009, 6:15 PM EDT) -- Mississippi is seeking to remand to state court a suit accusing Teva Pharmaceuticals Industries Ltd., two subsidiaries and Novopharm USA Inc. of systematically reporting inflated prices for pharmaceuticals purchased by a state health plan.

Mississippi Attorney General Jim Hood on Wednesday asked the U.S. District Court for the Northern District of Mississippi to kick his claims of fraud and false advertisement back to state court, stating that the defendants had not met the burden of proof necessary for removal.
