Law360, New York (September 4, 2009, 3:43 PM EDT) -- The federal government has moved for summary judgment in Applied Biosystems' U.S. Court of International Trade lawsuit disputing the duty classification of a group of imported thermal cyclers designed to replicate DNA, which the company says were taxed at more than twice the appropriate assessment of duty.
In a motion filed Sept. 3 the U.S. says no genuine material issues of fact are at stake and that it is entitled to summary judgment as a matter of law.
