EC Antitrust Ruling Against Clearstream Upheld

Law360, New York (September 9, 2009, 5:25 PM EDT) -- A European court has tossed Deutsche Borse AG subsidiary Clearstream Banking AG's challenge of a European Commission decision finding that it abused its dominant market position, the EC has announced.

In a statement Wednesday the EC said it “welcomes today's judgment” dismissing the action.

The EC in 2004 adopted a decision finding that Clearstream Banking and parent company Clearstream International SA, the custody and settlement division of exchange organization Deutsche Borse, violated the EC Treaty's ban on abusing a dominant market condition by refusing to supply...
