LendingTree Gets H&R Block Patent Partly Invalidated

Law360 (September 14, 2009, 7:09 PM EDT) -- In a victory for online loan aggregator LendingTree LLC, a federal judge has invalidated portions of a patent owned by H&R Block affiliate Block Financial Corp. that covers real-time financial card offers to Web customers.

In granting LendingTree's motion for partial summary judgment, Judge Ortrie D. Smith of the U.S. District Court for the Western District of Missouri agreed that two independent claims of the patent and 10 dependent claims were added by amendment in violation of the “new matter” prohibition.
