Court Scolds SEC Over Handling Of Document Request

Law360, New York (October 20, 2006, 12:00 AM EDT) -- A district court judge in Minnesota admonished the U.S. Securities and Exchange Commission over its handling of documents under the Freedom of Information Act, ruling that the agency must review documents before saying they cannot be released without harming ongoing law enforcement efforts.

In an opinion released this week, Judge Paul Magnuson of the U.S. District Court of Minnesota strongly urged the SEC to come to terms with SEC Insight Inc., a commercial research firm that requested material for several companies.
