US Fires Back In Tyco Suit Over Extinguisher Duties

Law360, New York (September 15, 2009, 5:30 PM EDT) -- The U.S. government has asked the U.S. Court of International Trade to dismiss a suit brought by Tyco Fire Products LP over duties on glass bulbs used in fire extinguishers, denying that it wrongfully liquidated certain bulbs imported by the company.

The federal government filed a response Monday in the CIT to Tyco's April 27 complaint accusing U.S. Customs and Border Protection of implementing a 5 percent ad valorem duty on imported glass bulbs that should have been assessed at a free rate of duty....
