Hitachi Sues Subcontractor In Power Plant Dispute

Law360, New York (September 16, 2009, 1:54 PM EDT) -- Hitachi America Ltd. is asking a federal court to vacate an $8.6 million award an arbitration panel said it must pay to a subcontractor that worked for Hitachi on a project to build a 790-megawatt coal-fired power plant in Council Bluffs, Iowa.

Hitachi filed an application Sept. 15 to vacate the award in the U.S. District Court for the Southern District of Iowa, saying the panel improperly granted the award to subcontractor Aker Kvaerner Songer Inc. because that company engaged in fraud, bad faith and breach...
