Judge Kicks Tires, Tosses Dirt Race Monopoly Lawsuit

Law360, New York (September 16, 2009, 2:58 PM EDT) -- A federal judge has thrown out an antitrust lawsuit accusing Indiana-based Hoosier Racing Tire Corp. of conspiring with a major dirt track racing organization to create a monopoly in the market for specialized tires.

Judge Terrence F. McVerry's ruling, issued Tuesday in the U.S. District Court for the Western District of Pennsylvania, said the plaintiff, Pennsylvania-based Specialty Tires of America Inc., failed to provide evidence demonstrating its losses were the result of an unlawful act.
