European Patent Office Declares Medinol Patent Invalid

Law360, New York (April 2, 2004, 12:00 AM EST) -- The European Patent Office has invalidated a patent for drug-coated stents, which has been at the center of a dispute between medical device makers Medinol and Boston Scientific in the Netherlands.

As a result, the injunction against the sale of these products in The Netherlands is no longer effective, Boston Scientific said.

The medical device maker said it expects to recommence sales in the Netherlands immediately.

The European Patent Office's decision is final and not appealable.
