Alcon Won't Appeal Laser Eye Surgery Ruling

Law360, New York (April 2, 2004, 12:00 AM EST) -- Swiss eye care company Alcon said it would not appeal a recent court decision in favor of Nidek over a dispute about patents for laser eye surgery.

The Court of Appeals for the Federal Circuit in Washington, D.C., last week upheld a December 2002 ruling by a lower court that overturned a jury verdict. The jury verdict had found that Nidek, the competitor, was infringing on Summit Technology Inc.'s patents covering some laser technology.

Alcon acquired Summit Technology in 2000 and owns the patents in question....
