Liberty, Century Fight Over Defense In Cleanup Case

Law360, New York (September 18, 2009, 1:01 PM EDT) -- Century Indemnity Co. is asking a federal judge to compel Liberty Mutual Insurance Co. to help cover a portion of the $6 million that Century paid to defend Emhart Industries Inc. in an environmental cleanup action related to dioxin contamination at a manufacturing site.

Century filed a motion for summary judgment Thursday in the U.S. District Court for the District of Rhode Island, saying that Liberty, which also insured Emhart, had not paid its fair share of Emhart's defense costs.
