State Department Embraces Age Bias: Suit

Law360, New York (September 18, 2009, 7:05 PM EDT) -- A Foreign Service officer allegedly denied a plum position because of her age has sued Secretary of State Hillary Clinton to overturn a mandatory retirement policy the plaintiff says is unconstitutional.

Elizabeth Overton Colton filed suit Friday in the U.S. District Court for the District of Columbia, claiming that the U.S. Department of State discriminated against her and continues to enforce the anachronistic and prejudicial retirement age set by the Foreign Service Act.
