Mining Permit Case Stayed Pending Corps' Review

Law360, New York (September 21, 2009, 4:11 PM EDT) -- A judge has stayed a lawsuit challenging a nationwide mining permit over alleged violations of the Clean Water Act because the U.S. Army Corps of Engineers under the Obama administration said it would consider suspending the program.

Judge David L. Bunning ordered the stay and dismissed without prejudice cross motions for summary judgment in his ruling, filed Sept. 18 in the U.S. District Court for the Eastern District of Kentucky.
