Vape Group's Challenge To FDA's E-Cig Policy Falls Flat
Law360 (January 16, 2020, 6:42 PM EST) -- A Kentucky federal judge on Thursday tossed a vaping trade organization’s bid to postpone a court-mandated deadline for the U.S. Food and Drug Administration to begin enforcement action on e-cigarettes, finding the group had failed to show why the agency should be accountable for a judge’s decision.
The order dismissing the case for lack of standing comes two weeks after the FDA announced that it would begin restricting the sale of all electronic nicotine delivery systems without premarket authorization beginning on May 12 — the same deadline at the crux of the vape group's challenge.
