FTC Backs Teva In Zoloft Patent Suit

Law360 (April 5, 2004, 12:00 AM EDT) -- The U.S. Federal Trade Commission has filed an amicus curiae brief with the U.S. Court of Appeals for the Federal Circuit, supporting Teva Pharmaceutical Industries Ltd. in its litigation against Pfizer over its right to make a generic version of the top-selling antidepressant Zoloft.

Teva is seeking the reversal of a district court order dismissing its declaratory judgment against Pfizer. The Israeli generic maker had sought a court ruling that it does not infringe on the brand-name patent before it releases its generic version.
