10th Circ. Backs Damages In Metal Trade Secrets Suit

Law360, New York (September 22, 2009, 1:34 PM EDT) -- A federal appeals court has handed down a mixed ruling in a dispute between two metals companies involving a pair of employees who worked for both, affirming a district court's award of damages and an injunction arising from the workers' noncompetition agreements and reversing damages for misappropriation of trade secrets.

A three-judge panel of the U.S. Court of Appeals for the Tenth Circuit on Sept. 21 handed down the ruling and remanded the matter to the district court for a judgment in favor of the workers...
