Sixth Circuit Reverses EEOC's Anti-Retaliation Victory

Law360, New York (October 25, 2006, 12:00 AM EDT) -- A federal appeals court on Wednesday reversed an anti-retaliation ruling granted to the U.S. Equal Employment Opportunity Commission, rejecting the agency’s claims that a health care facility punished a laid off employee for not signing a litigation waiver.

The ruling from U.S. Court of Appeals for the Sixth Circuit was a victory for defendant SunDance Rehabilitation Corp., which was sued in 2001 for allegedly declining to rehire an employee because she refused to sign away her rights to file EEOC lawsuits.
