DOJ Hits Mass. Corrections Dept. With Sex Bias Suit

Law360, New York (September 28, 2009, 5:36 PM EDT) -- The U.S. Department of Justice has hit Massachusetts and its Department of Corrections with a discrimination suit accusing them of unfairly denying employment to female applicants for entry-level correctional officer positions.

The MDOC and the state violated Title VII of the Civil Rights Act of 1964 by failing or refusing to hire the women on an equal basis as men and by requiring as part of its hiring process an allegedly unlawful physical abilities test that disproportionately screened out female applicants, according to the complaint filed...
