Upping Competition Law Compliance For UK Directors

Law360, New York (September 29, 2009, 5:44 PM EDT) -- On Aug. 18, 2009, the UK Office of Fair Trading published a consultation on significant proposed changes to its guidance on the adoption of competition disqualification orders (CDOs) against company directors.

The OFT and regulators believe that the current guidance does not maximize the deterrent effect of CDOs and have therefore proposed changes that present a significantly more aggressive approach in seeking to force directors to take greater responsibility to ensure that their companies comply with competition law.
